1. Who you are dealing with

Phantom Routes is operated by Triple DL Pty Ltd("we", "us", "the seller"). By creating an account or using the Phantom Routes app or website (the "service"), you agree to these terms and contract with Triple DL Pty Ltd.

2. The service

Phantom Routes helps drivers plan Western Australian journeys by combining road closures, roadworks, emergency alerts, vehicle restrictions and load limits into a single trip briefing. It is a planning aid only.

3. Important safety disclaimer

Road information may be delayed, incomplete or incorrect. The service does not replace road signs, official directions, pilot/escort requirements, permits or your own judgement. You must always obey road signs, traffic signals and directions from police, emergency services and road authorities. Triple DL Pty Ltd accepts no liability for misleading information, accidents, losses or damages arising from use of the service.

4. Your account

You must provide accurate information, keep your login details confidential, and are responsible for all activity under your account. You must be of legal age to enter these terms.

5. Acceptable use

You must not misuse the service, including:

  • using it for any unlawful purpose, fraud or spam;
  • infringing intellectual property rights;
  • interfering with the service's security, introducing malware, probing, or scraping it;
  • reverse engineering, reselling or redistributing the service, or circumventing its technical limits.

6. Subscription and payment

Phantom Routes is offered as a monthly subscription (currently $9.99 AUD per month) or an annual subscription (currently $99 AUD per year), each with a 7-day free trial for new subscribers). Subscriptions renew automatically until cancelled. Payment, billing, tax, cancellation and refund mechanics are handled under Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms).

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Intellectual property

We retain ownership of the service and its intellectual property, including software, branding and documentation. We grant you a limited, non-exclusive, non-transferable right to use the service within your subscription.

8. Service availability

We do not guarantee the service will be uninterrupted or error-free. To the fullest extent permitted by law, all implied warranties are disclaimed.

9. Liability

To the fullest extent permitted by law, we exclude liability for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death or personal injury.

10. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your account data may be deleted after a reasonable period.

11. General

These terms are governed by the laws of Western Australia. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control.
